Terms of use
- Logic bunny Pvt Ltd mobile application (the “Application”) and the website Rummyfield.com (the Application and the Website collectively referred to as the “Portal”) as accessible through various platforms is owned and operated by Logic bunny Pvt Ltd (the “Service Provider or Provider”) (“we”, “us”, “our”), a company incorporated under provisions of the Companies Act, 2013 having its registered offices.
- These Terms of Use lay down the terms and conditions which any person willing to access the Website or Application (the “User”) will be required to consent to and abide by in advance. The User by using the Portal agrees to adhere to and abide by all the terms and conditions as enumerated herein.
- Any non-compliance or contravention of these Terms of Use by any User shall immediately result in the termination of User-Service Provider relationship.
- The User shall keep the Service Provider indemnified against any act, commission, omission, contravention, default, etc. which occur solely due to the User’s conduct.
- The Service Provider reserves the sole and exclusive right to change, amend, alter or substitute the Terms of Use at its own discretion without any prior notice to any party.
- The Terms of Use so changed, amended, altered or substituted shall be effective immediately on notification save as anything to the contrary is specified herein.
- The Terms of Use as provided herein for our real money rummy game are to be deemed gender neutral by the User and anything contained herein referring to genders or sexes such as he, him, his etc. shall be construed as a reference to all the genders and sexes.
- The User hereby agrees that he has carefully perused the Terms of Use before making any use of the Portal whatsoever.
- User is hereby notified to visit this page frequently to keep abreast of the changes made herein.
- The User agrees and declares that he shall not use the Application or any functions therein for any purposes contrary to the provisions of any law for the time being in force.
Usage of the Application:
- Every User making use of the Portal in any manner whatsoever including but not limited to viewing, navigating, downloading or registering the Application is bound by the Terms of Use specified herein.
- The User shall be bound by some additional terms or covenants not specified herein in case he decides to opt-in for certain functions or aspects or parts of the Application which may not otherwise be available for access without adherence to those specific terms or covenants.
- The Service Provider may, without prejudice to any other remedies available under the law or equity, do the following acts if any User is found to be violating the Terms of Use as specified.
Herein:
- Suspend, restrict or otherwise limit the User’s access to his account for the time being.
Delete or remove the User’s account permanently.
- Forfeit any prizes or awards accrued but not distributed to the User.
- Pass on any information to the relevant government officials/ authorities.
- Delete or remove any information posted by a User on the Portal.
- The Service Provider reserves the exclusive right to make any changes, alternations, amendments or substitution to the content, method, design, criterion, prize or any other aspect of the Portal without any prior notice to the User.
- The Service Provider reserves the right to start charging certain fee for providing accessibility to certain features of the Portal without any prior notice to the User.
- The Service Provider reserves the right to suspend User’s account without prior notice till payment due in respect of the usage of Portal is done by the User.
- The User hereby agrees and declares that this Application shall not be used in contravention of the provisions of any law.
- The User hereby agrees and declares that if any contravention of the provisions of any law through use of the Portal comes to the notice of the Service Provider, the Service
- Provider reserves exclusive right to suspend, delete or terminate the account of such User without notice.
- The User hereby agrees to indemnify and hold the Service Provider harmless for any harm, loss, liability, injury or damage arising out of the User’s contravention of the provisions of any law.
- The User hereby agrees to receive communications through various modes such as messages, e-mail or social media regarding the usage of the Portal.
User Eligibility & Conduct:
- The User hereby agrees and declares that he has attained the age of majority as governed under the provisions of the Indian Majority Act, 1875 (Act No. 9 of 1875).
- The User who is not a major under provisions of the Indian Majority Act, 1875 (Act No. 9 of 1875) is prohibited from viewing, navigating, downloading, registering or otherwise making the use of the Portal.
- The User hereby agrees and declares that he is competent to contract under the provisions of the Indian Contract Act, 1872 (Act No. 9 of 1872).
- The User who is not competent to contract under provisions of the Indian Contract Act, 1872 (Act No. 9 of 1872) is prohibited from viewing, navigating, downloading, registering or otherwise making the use of the Portal.
- The Service Provider hereby expressly disclaims any liability arising out of any injury, damage or action on account of the use of the Portal by any User who uses the Portal in any manner whatsoever by making false representations.
- The User by viewing, navigating, downloading, registering or otherwise making the use of the Portal declares that he is a citizen of India residing within the territories of the Republic of India.
- The User by viewing, navigating, downloading, registering or otherwise making the use of the Portal agrees and declares that he does not reside or is not making the use of the Portal from within the physical boundaries of the states which prohibit participation in games involving stakes.
- The User by viewing, navigating, downloading, registering or otherwise making the use of the Portal agrees and declares that he is not making the use of the Portal from within the physical boundaries of the states of Telangana, Assam, Odisha, Nagaland or Sikkim.
- The User agrees and declares that he is not indulging in any activity in contravention of the provisions of any law and if so, he shall indemnify the Service Provider on account of any harm, loss, liability, injury or damage arising out of such conduct of the User.
- The User agrees that if the State Legislature of his respective state of residence prohibits the online gaming activities such as the ones available through the Portal, the concerned User shall immediately delete his account from the Portal and shall not use the Portal.
Fair Play Policy
- The User undertakes to adhere and maintain conduct for the promotion of fair play which includes but is not limited to.
- The User agrees to use only civilized language in the chat box option available to the Users. It is clarified that use of inappropriate language may lead to account deletion of the User.
- The User shall not register or operate more than one User account with the Service Provider.
- The User agrees not to use any cheat codes, exploits, automation, software, bots, hacks or any unauthorised third party software designed to modify or interfere with the Service Provider’s Services.
- The User agrees not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in or otherwise transfer any right to the technology or software underlying the Service Provider’s Services.
- User agrees not to institute, assist or become involved in any type of attack, including without limitation to distribution of a virus, denial of service or other attempts to disrupt the services of the Service Provider or any other person’s use or enjoyment of such Services.
- The Service Provider may, without prejudice to any other remedy available to it under law and equity, upon identification of any spurious acts in violation of these Terms of Use, reserves the right to take appropriate actions against such User, including but not limited to, suspend, restrict or otherwise limit the User’s access or delete the User’s account permanently.
- The decision of the Service Provider in regard to the accounts of the User in respect of this clause shall be final and binding.
User Registration:
- The User will be required to register himself on the Application in order to gain access to certain features of the Application.
- The User will be required to provide certain information for registration on the Portal.
The User may be required to provide the following information:
1. Name
2. Age
3. Date of Birth
4. State of Residence
5. Residential Address
6. Photograph
7. E-mail Address
8. Phone/Mobile No. etc.
The User may also be required to furnish additional information on the basis of his preferences to avail certain features of the Portal. This information may include the following:
1. Bank Account No.
2. Credit/Debit Card No.
3. Bank Branch IFS Code
4. Bank Branch Address
5. Passbook Details
6. Cancelled Cheque, etc.
- The User shall solely and exclusively be responsible for providing his correct, accurate and up-to-date information on the Portal.
- The User shall update his information as and when there is any alteration, change or amendment in any of the information provided on the Portal.
- The User will be notified of his log-in credentials through e-mail on conclusion of his registration on the Portal.
- The User shall be solely and exclusively liable for maintaining secrecy and confidentiality of his log-in credentials for the Portal.
- The User will be given an option to change the password for his account on the Portal in case of loss or compromise of password.
- The User agrees to indemnify and hold harmless the Service Provider for any harm, liability, injury, damages or loss arising out of the loss or compromise of log-in credentials due to the his own act or omissions.
User Payments:
- Once the User has registered himself on the Portal by creating an account after providing correct and up to date necessary information, a closed Electronic Wallet shall be created for his account on the Portal to monitor and manage their transactions with the Provider.
- Once the Electronic Wallet becomes functional, all payments made to the Electronic Wallet shall be made through payment methods as may be made available by the Service Provider on the Portal from time to time.
- This Electronic Wallet shall be used by the User only for conducting transactions within and for the purposes of the Portal.
- The Service Provider shall allow the User following options for processing and reconciliation of payments –
- Unutilized amount: The amount added by the User using various payment gateways, into his account/ electronic wallets which has not been used for entering into contest/ tournament/ game. This amount can be used by the User only for the purpose of entering into any tournament/ game and is in no case permitted to be withdrawn by the User. This unutilized amount may be used to improve the Service Provider’s software functionality, User’s account security and providing an overall better experience to the User. This does not affect the User’s right to utilize the unutilized amount to invest further to play more tournament/ games at the Service Provider’s Platform;
- Winning/Withdrawable amount (hereinafter referred to as “reward points”): The amount which is added to the account of the User after he has won any particular contest/ tournament/ game on the Portal. This amount can be withdrawn by the User, and also can be used to join contest/ tournament/ game on the Portal.
- Bonus rewards: The Provider may at its sole discretion issue bonus rewards to the User for the purpose of promotion/ encouragement for participation in any contest/ tournament/ game for a prescribed time period and the same shall be exhausted after the expiry of the same. The bonus rewards also have a daily spending limit which shall be determined by the Service Provider. The said amount may be used to enter any tournament/ game only on the Portal and for no other purpose, including but not limited to, transfer to any other account, withdrawal etc.
- The Electronic Wallet shall be used by the Service Provider to transfer the reward amounts or for making any other such remittances to the User’s account as the User may become eligible to receive from time to time, including but not limited to, refunds, cashbacks etc. All such amounts and transactions mentioned under Clause 6 shall be subject to Tax deducted at Source (TDS) as per the Income Tax Act, 1961.
- All monetary transactions on the Portal shall be conducted by the User exclusively through the use of Electronic Wallet activated for the User by the Service Provider.
- It is hereby clarified that the Service Provider shall not be liable to pay any interest over the amount stored by the User in his account/ electronic wallet.
- The User shall mandatorily provide his Permanent Account Number (PAN) along with associated details on the Portal in order to make the Electronic Wallet functional.
- The User shall not provide any PAN and associated details other than his own as legally and validly assigned to him by the government authority under relevant provisions of the law. The User shall be exclusively liable for providing any false or fraudulent PAN and associated details, whether intentionally or otherwise, on the Portal.
- The User hereby agrees, undertakes and declares that he shall not use his PAN and associated details for activating more than one Electronic Wallet on the Portal.
- If the User uses his PAN and associated details to activate or use more than one Electronic Wallet, then the Service Provider, on coming into knowledge of such use, reserves the right to terminate all such Electronic Wallets which have been activated by use using the same PAN and associated details. The User shall be liable for forfeiture of all the moneys deposited in all such Electronic Wallets which have been activated by the use of same PAN and associated details and subsequently terminated by the Service Provider.
- The Service Provider further reserves the right to suspend or delete a User’s account without any prior notice and pursue any legal remedies as may be available under the law or equity.
- Once a User’s account has been deleted by the Service Provider from the Portal, the Service Provider may further delete all such information associated with such an account at its sole discretion except that which the Service Provider is statutorily mandated to maintain in its records.
- The User may further be barred by the Service Provider from participating in any future activities on the Portal, including but not limited to, participation in events, registration through a new account, logging-in to a suspended account, etc.
- The User hereby agrees, undertakes and declares that the Electronic Wallet shall be used exclusively for the purposes none other than the ones related or ancillary to the Portal.
- The User hereby agrees, undertakes and declares that the Electronic Wallet shall not be used in any manner that may be in contravention of the provisions of any law for the time being in force.
- The User shall indemnify the Service Provider for any liability, loss, harm, action, damages or injury arising out of or on account of the User’s wrongful use of PAN and associated details on the Portal for any purpose which may be in contravention of the provisions of any law for the time being in force.
- In case a User’s account is inactive for a period of more than a year then his account shall be deactivated by the Service Provider and the unutilized amount in his Electronic wallet shall be deemed to be forfeited.
Third Party Input
- The Portal may contain links to third party websites. By accessing such links, the User shall be bound by the Terms of Use of such third party website. The Service Provider does not have any control over such third party websites and does not warrant any use thereof. The User agrees that the Service Provider is not responsible or liable in any way with respect to the content of the third party websites. It is further clarified that availability of third party link/ content on the Portal is not an endorsement of any sort by the Service Provider. The User shall be solely responsible for any loss or damage of any sort incurred as a result of transactions with such third parties.
- The User is hereby informed that while accessing the Portal, the Service Provider and the User might have to rely on information/ data / statistics provided by the third parties. The User agrees that the Service Provider relies on such input of data from third parties and that the Service Provider shall not be responsible or liable in any manner with respect to the accuracy, quality or any delay in accessing such data or the content/ data displayed by the Service Provider by relying on the information/ data / statistics provided by such third parties.
The Contest/ Tournament on the Portal:
- The User can take part in any of the contests being offered by the Service Provider on its Portal upon payment of the relevant fees.
- The Service Provider reserves the right to disqualify a User from participating in a tournament/ contest as per its own discretion.
- A disqualified User shall not be allowed to participate in any tournament/ contest during the term of his disqualification.
Winner Selection:
- The winner of the contests organized on the Portal shall be declared on the Portal at the end of the particular contest.
- The winner shall be selected from among the registered User in the contest on the basis of his rank on the scoreboard.
- The User with the highest score on a tournament/ contest’s scoreboard shall be declared as top ranker of the contest.
- A tournament/ contest may have more than one winner if there is more than one User who have the same highest score on the tournament/ contest’s scoreboard.
If there is more than one winner, the prize money shall be equally divided among such number of winners.
- In case of any tournament/ contest where the minimum number of Users as specified therein for conducting the contest have not joined the contest then such contest may be cancelled and the entry fees deducted from the User’s wallet shall be refunded to the User’s wallet with the Service Provider.
- In case a tournament/ contest could not be organized by the Service Provider on its Portal for any reason whatsoever, such tournament/ contest organized by the Service Provider shall also be cancelled and any entry fees paid by any User for such contest will be refunded to such User’s electronic wallet with the Provider. It is clarified that any refunds to which the User becomes eligible will take at least 5 to 7 working days to be processed.
Winner Identification:
- The User who wins any contest or competition conducted by the Service Provider on the Portal shall be identified on the basis of information provided by respective User during registration on the Application and as updated by the User from time to time.
- The User shall be liable to provide all the additional information as may be sought by the Service Provider for the purpose of User Identification.
- The User shall be liable for forfeiture of the winning prize in case of any discrepancy in any information provided by the User.
- The User hereby agrees to indemnify and hold the Service Provider harmless against any harm, loss, liability, injury or damage arising due to the User furnishing any false information to the Service Provider.
Game of Skill:
- The Portal offers games of skill where the outcome is determined predominantly by User’s knowledge, mental skills and statistical analysis of various attributes, including but not limited to, performance of the player, their form, age, statistical trends, current form, injuries, the athlete’s statistics, upcoming matches, match locations and other material causative factors etc. and not on the basis of chance.
- The games offered on the Portal of the Service Provider require the User to use substantial degree of skills, knowledge, alertness, experience, adroitness, and hence they fall within the purview of games of skill recognized by the Supreme Court of India.
- Playing of fantasy games like the games offered on the Portal of the Provider by any User involves selecting virtual team by him which requires a considerable skill, judgment and discretion. The User has to analyze and determine the relative worth of each athlete/sportsperson in relation to all other athlete/sportspersons available for selection. The fantasy games offered on the Application/ platform of the Provider is unlike any gambling activity as the fantasy games offered on the Application/ platform of the Provider involve substantial degree of skills and knowledge as opposed to mere chance.
- The User is hereby informed that the games being offered on the Portal of the Service Provider is for the territory of India except in the states of Telangana, Assam, Odisha, Nagaland and Sikkim. The User from any of these States is not permitted to access the games offered on the Portal.
- Games of skill are legal, as they are excluded from the ambit of Indian gambling legislations including, the Public Gambling Act of 1867. The Indian Supreme Court in the cases of State of Andhra Pradesh v. K Satyanarayana (AIR 1968 SC 825) and KR Lakshmanan v. State of Tamil Nadu (AIR 1996 SC 1153) has held that a game in which success depends predominantly upon the superior knowledge, training, attention, experience and adroitness of the player shall be classified as a game of skill.
- By participating in this Contest(s), each Participant acknowledges, understands and agrees that he/she is participating in a game of skill.
Disclaimer:
- The Service Provider hereby expressly disclaims any responsibility for the completeness, veracity or accuracy of the information provided on the Portal.
- The Service Provider hereby expressly disclaims any liability arising on account of any act of legislature through which activities as provided on the Portal may be prohibited.
- The Service Provider hereby expressly disclaims any harm, loss, liability, injury or damage arising on account of any change, amendment, alteration or substitution in the Terms of Use.
- The Provider hereby expressly disclaims any harm, loss, liability, injury or damage to the User or his computer systems arising on account of use of the Portal.
The Service Provider hereby expressly disclaims any harm, loss, liability, injury or damage which may arise on account of any suspension, termination, closure or stoppage of services by the Service Provider.
- The Service Provider hereby expressly disclaims any responsibility for the links of other internet sites owned and operated by third party as may be available on the Portal. The Service Provider is not liable for User’s correspondence, transactions or related activities with third parties, including payment providers and verification service providers, which are solely between the User and that third party.
- The Service Provider is not responsible for any misuse of the User’s account by the User or any other party.
Unless otherwise explicitly specified, the Portal is not affiliated in any way to and claims no association, in any capacity whatsoever, with any sports governing bodies and leagues, including, but not limited to the Board of Control for Cricket in India (BCCI) or the Indian Premier League (IPL).
Force Majeure:
- The Service Provider shall not be liable for any harm, injury, damages, loss or liability arising on account of any circumstances beyond the control of the Service Provider (hereafter referred to as “Force Majeure”), including but not limited to, acts of any third party, accident, fire, flood, earthquake, landslide, lightning strike, volcanic eruption, tsunami, war, naval blockade, embargo, international sanction, international action, terrorist attack, riots, civil disturbances, acts of the military or police authorities, any notice, summon, order, decree or judgment of any public authority or the court of law etc.
- The Service Provider shall not be liable for performance of any acts or obligations if it has become impractical to perform such acts or obligations on account of any Force Majeure circumstances.
Intellectual Property Rights:
- The User hereby acknowledges that the Service Provider is the sole and exclusive owner of all the intellectual property as displayed to the User on the Portal, including but not limited to, trademarks whether registered or unregistered, trade names, trade dress, designs, logos, graphics, content arrangement, software, algorithms, web designs, user interface, page codes, etc.
- The User hereby agrees and declares that he shall not use the Service Provider’s intellectual property in any manner that is detrimental to the Service Providers’ interests.
- The Users hereby agrees to indemnify the Service Provider and keep the Service Provider indemnified for any harm, loss, injury, damage or liability arising on account of the User’s acts or omissions.
Dispute Resolution:
- Any dispute arising out of any use of the Portal whatsoever shall be resolved in accordance to the provisions of the Arbitration and Conciliation Act, 1996 and the rules made thereunder as amended from time to time.
- The award passed by the Arbitral Tribunal under provisions of the Arbitration and Conciliation Act, 1996 shall be final and binding on all parties to the dispute.
Indemnity
- The User agrees to indemnify, defend and hold harmless the Provider and its affiliates and their officers, directors, employees, contractors, agents, licensors, service providers, subcontractors and suppliers from and against any and all losses, liabilities, expenses, damages and costs, including reasonable attorneys’ fees and court costs, arising or resulting from the use of the Portal and any violation of these Terms of Use or any applicable law in force.
- Notwithstanding anything contained herein, User understands and agrees that the aggregate liability of the Service Provider to the User in any scenario whatsoever shall not exceed INR 50.
Severability:
- If the provisions of these Terms of Use or any part thereof is declared illegal, inoperative or void by the order, decree or judgment of the court of competent jurisdiction or any rule, regulation, notice or any other act of any authority or the legislature, then such provisions or part thereof shall be construed as severed from these Terms of Use.
- In such a case, the remainder provisions or any part thereof shall have full operability irrespective of any other provisions being declared illegal, inoperative or void.
Waiver
No waiver of any provision hereof shall be effective unless made in writing and signed by the Service Provider. Any failure of Service Provider to demand the performance of any term or obligation set herein, or the waiver by Service Provider of any breach herein, shall not prevent any subsequent enforcement of such term or obligation or be deemed to be a waiver of any subsequent breach.
Governing Law
These Terms of Use shall be construed in accordance with the laws of Republic of India. The rights, obligations and remedies of the parties hereunder shall be determined in accordance with such laws.
Jurisdiction
Any dispute arising in relation to or subsequent to the Arbitration Proceedings shall be subject to the exclusive jurisdiction of the Courts of Noida, Uttar Pradesh.
